If you provide us with data about other individuals (e.g., colleagues), we assume that you are authorized to do so and that the data is accurate. By transmitting data about third parties, you confirm this. Please also ensure that these third parties have been informed about our privacy policy.

This privacy policy is designed to comply with the requirements of the EU General Data Protection Regulation (GDPR) and the revised Swiss Data Protection Act (revDSG). However, the applicability of these laws depends on the specific circumstances.

3. Data Processing when Using Our Website

When you visit our website trib3s.com without contacting us, we do not process personal data. We do not use cookies and do not track users across websites. We use self-hosted Umami, a privacy-focused alternative to Google Analytics.

4. Data Processing in Contract Initiation or Execution

If you have entered into a contract with us, intend to conclude a contract with us, or have contacted us for other reasons, the following personal data may be processed:

  • Communication Data: When you contact us via contact forms, email, phone, chat, postal mail, or other communication methods, we capture the exchanged data between you and us, including your contact details and communication details.
  • Master Data: Master data refers to the basic data we require, along with contract data (see below), for the management of contractual and other business relationships. This may include your name, contact information, information about your role and function, customer history, and consent declarations. We process your master data if you are a customer or have other business contact with us, or if you are acting on behalf of such a party (e.g., as a contact person for a business partner). We receive master data from you directly (e.g., during registration), from the organizations you are associated with, or from third parties such as our contract partners or publicly accessible sources like public registers or the internet (websites, social media, etc.).
  • Contract Data: These are data associated with contract initiation or execution, such as details about contracts and the services to be provided or already provided. This also includes data related to pre-contractual interactions, necessary or used information for contract execution, and information about reactions (e.g., complaints or satisfaction feedback). We typically gather this data from you, contract partners, involved third parties in contract execution, and publicly accessible sources.
  • Other Data: We also collect data from you in other situations. For example, data may be generated in connection with regulatory or legal procedures (such as records, evidence, etc.) that may pertain to you. The retention period for such data depends on the purpose and is limited to what is necessary.

5. Legal Grounds for Data Processing

Your personal data may be processed based on the following legal bases:

  • Contract Initiation or Execution
  • Legal Obligation
  • Consent provided by you or an authorized representative
  • Legitimate interest of contentfry to carry out data processing, particularly to pursue the described purposes and related goals and to implement corresponding measures.

6. Data Transfer and Recipients of Your Data

In the context of our contracts, website, services, legal obligations, or otherwise to safeguard our legitimate interests, we may disclose your personal data to third parties, particularly to the following categories of recipients:

Authorities: We might share personal data with authorities, courts, and other governmental bodies both domestically and internationally if legally obligated or permitted, or if it appears necessary to safeguard our interests. These authorities process data about you in their own responsibility based on the data they receive from us.

Others: This refers to other cases where involving third parties is derived from the purposes, such as if you are part of one of our publications.

All these categories of recipients may involve third parties themselves, so your data could also be accessible to them. We can restrict the processing by certain third parties (e.g., IT providers), but not by others (e.g., authorities, banks).

7. Transfer of Personal Data Abroad

As explained in Section 10, we also disclose data to other entities. Therefore, your data can be processed in both the EU/EWR and the USA.

8. Retention Periods for your Data

We store and process your data only for as long as our processing purposes, legal retention periods, and our legitimate interests in processing for documentation and evidentiary purposes require, or if storage is technically necessary. If there are no legal or contractual obligations opposing this, we delete or anonymize your data after the storage or processing period as part of our regular procedures.

9. Data Protection Measures

The data you provide to us is not sold, rented, or traded by us.

We implement reasonable security measures to maintain the confidentiality, integrity, and availability of your personal data. These measures are put in place to protect against unauthorized or unlawful processing, as well as the risks of loss, accidental alteration, unintended disclosure, or unauthorized access, such as IT and network security solutions, access controls and restrictions, or encryption of data carriers and transmissions.

10. Your Rights

To facilitate your control over the processing of your personal data, you have the following rights in connection with our data processing, depending on applicable data protection law:

  • The right to request information from us as to whether and what data we process about you.
  • The right to have incorrect data corrected.
  • The right to request the deletion of data.
  • The right to request the release of certain personal data from us in a common electronic format or its transfer to another controller.
  • The right to withdraw consent if our processing is based on your consent.
  • The right to request further information necessary for the exercise of these rights.

If you wish to exercise the above rights with us, please contact us in writing by email; you can find our contact details in Section 3. To prevent abuse, we must identify you (e.g., with a copy of your identification, if otherwise not possible).

Please note that there may be conditions, exceptions, or limitations for these rights under applicable data protection law (e.g., to protect third parties or trade secrets). We will inform you accordingly if necessary.

If you are not satisfied with our handling of your rights or data protection, please let us know. Especially if you are in the EEA, the United Kingdom, or Switzerland, you also have the right to lodge a complaint with the data protection supervisory authority of your country.
